This Privacy Policy (“Policy”) explains how personal information is collected, used, shared and protected by Dining Hour (“Dining Hour”, “we”, “our”, or “us”) when you use, access and interact with our services ("Services"), including without limitation, through our websites, mobile applications, or other online services (collectively “Site”). This Policy applies to visitors and users (individually “you”) of Dining Hour’s websites, mobile applications and other online services. By visiting the sites, using or accessing the services, to the extent permitted by applicable law, you acknowledge that you accept this Policy and you are consenting to us to collect, gather, transfer, store, disclose and use your information as in accordance with the provisions of this Privacy Policy.

Your use of Dining Hour services is subject to our Terms of Service. The definitions and Terms as laid down in the Terms of Service will also be applicable on this Policy.

1. What Does This Privacy Policy Cover?

This Privacy Policy covers the treatment and protection of “Personal Information” collected by us when you are using or accessing the services on or through our Site and Application. Third parties such as restaurants at which you may make reservations, social networks that you use in connection with our Sites may also collect, use, and share information about you. This Policy does not cover such third parties or their services and we do not take any responsibility for how such third parties may use any of your information they collect. For information about third-party privacy practices, please consult with them directly.

2. Update and Changes

We may, from time to time, in our sole discretion, with or without notice amend, update or modify the provisions of this Policy at our sole discretion. Such amendments, updates or modifications will be effective when published on or through the Services or Site. It is your sole responsibility to check and review these changes regularly. Your continued access or use of the Site and Application after any such modifications or amendments shall indicate your acceptance to continue to be bound by the Privacy Policy as modified or amended.

3. Information We Collect

We collect information from you in order to provide, personalize, improve and continue to operate the service as requested and expected by you. When you create your account in order to use our services you may need to provide certain information that could be personal information such as: your name, email address, phone number, date of birth, gender, photo, login information, billing information, current and present restaurant reservation details, booking path, account settings, passwords, your contact information, your restaurant reservation details through our sites, restaurant reviews and other information which you provide on our sites. We may also use your credit or debit card information for certain services. We do not collect any of your personal information which may be considered as sensitive information. By creating an account for the services you acknowledge that the information which we ask or collect may be personal to you, but by providing such information to us you allow us and others to use that personal information, including for the purpose of identifying you.

3.2 Usage Information

We automatically receive and record information from your web browser or mobile device which you use to access or use our services including your IP address information. Generally the services we provide automatically collect your usage and activity in our sites to analyse and improve the services which we provide.

3.3 Location Information

While you are using or accessing our sites we may receive your geographical location with your consent. We may use and store such information to better provide and improve the features of our sites, for example, to show you the nearby restaurants as per your location.

3.4 Third Party Platform Information

We may also obtain information about you from other sources, including but not limited to third party websites, applications, and services (each, a "Third Party Platform"), such as Twitter, Facebook, or LinkedIn, through which you connect with or use to interact with our Services and we may combine that with information we collect. Please note that the manner in which a Third Party Platform uses, stores, protects and discloses your information is governed by the privacy policies of such Third Party Platform.

3.5 Booking or Reservation Information

When you use the services to request or book reservations at restaurants we may also collect and store your information related to your search or the reservation you made (booking behaviour) including but not limited to, information that restaurants may provide to us when you interact with them for reservation through our services, infromation related to type of restaurants with which you request for reservation, the number of requests/reservations you have cancelled, the aggregate infromation such as total number of reservations you have made.

4. How We Use Your Information

Our main purpose for the collection and use of your information is to improve the service we provide to you and to give you satisfactory services as per your requirements and expectations. Thus we may use your information for the purposes such as: to allow you to create a user account and profile; to send you the infromation regarding your request or reservation; to send you information relating to the services, including technical notices, updates, security alerts or any other message regarding the service; to understand your requirements and to personalize your experience and enjoyment using the services; to communicate with you any offer/discount, upcoming events/news about the services offered by us, participating restaurants and our business partners; to protect against any illegal or fraudulent activities.

4.1 Combined Information

We may combine information which you provide us, such as personal information, device information, location or any other information to serve you better and for advertisement and improvement purposes.

4.2 Electronic Communication

With a view to provide our services to you efficiently and to improve our customer service we may communicate with you via electronic messages, including e-mails, text message, or mobile push notification, for example: to send you information regarding your request for reservation in restaurants; reservation confirmation; updates, security alerts and other administrative messages. We may also anytime contact you at your mobile or phone number which you have provided to us for any of the purposes of our services.

4.3 Aggregate Information

We may aggregate information collected from you and other users as well as device information and location information to produce general statistics and analytical studies with which we attempt to improve our service and to provide you better experience.

4.4 Retention

We will retain your information for as long as your account with Dining Hour is active and as is needed to provide you the Services. Even after your account is terminated, we may retain your information (including, but not limited to, Personal Information and Usage Information) as needed to comply with our legal, statutory and regulatory obligations, resolve disputes, conclude any activities related to cancellation of an account, investigate or prevent fraud and other inappropriate activity, to enforce our agreements, and for other business reasons and as is necessary for us to provide our Services effectively.

4.5 Information Disclosed due to Business Transfers

We may disclose or transfer your Personal Information to a third party if we sell, transfer, divest, or disclose all or a portion of our business or assets to another company in connection with or during the negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction, or proceeding.

5. How We Share Your Information

We share the information which we have collected from you only for the purposes and in accordance with the manner provided in the Privacy Policy and Terms of Services:

5.1 Information shared with Restaurants

When you make a request by accessing or using our services such as restaurant reservation/booking, we provide your information to the restaurant in order to facilitate your request, such information may include without limitation your name, phone number, e-mail address, your user profile, time and date of visit, any special request or comment if you choose to submit. The restaurant may also send notification to your given mobile or phone number regarding your request for reservation. When you make request through our services we may also share other information with the restaurant such as information about your reservation, prior reservation activity or history with that restaurant if any and information we collect from third parties. We share information with the Restaurant to help them understand our audience and confirm the value of advertising on our Site.

5.2 Information Shared with Our Agents and Affiliates

We may share your personal information with our affiliates, associates, employees, partners (collectively, “Agents and Affiliates”) in connection with our services. We only share your personal information with our Agents and Affiliates when it is necessary in order to provide you our services as per your request and expectations.

5.3 Information You Shared Socially/Publicly

You may be allowed or open to share your information, comment, action, content publicly or with others whom you want. You must be careful about your privacy for any of such sharing as we cannot control the privacy or security of your information you choose to make public or share with others.

We reserve the right to access, preserve and disclose any information that we believe is necessary to comply with applicable laws, our Terms of Service, to enforce any agreement or to protect the rights, safety, and reputation of Dining Hour, our employees, our users or others. We may disclose information about you to third parties if we have a good faith belief that such a disclosure is reasonably necessary to

  • enforce or apply our Terms of Service and Privacy Policy
  • comply with legal process or other government inquiry
  • protect our rights, reputation, and property, or that of our users, affiliates, or the public
  • detect, prevent or otherwise address fraud, security or technical issues.

7. Security of Your Information

Your account is protected by a password for your privacy and security. You are solely responsible for maintaining the confidentiality of your Account and your Account Information, and, except as otherwise required by applicable law, you are solely responsible for all use of your Account, whether or not authorized by you. You must prevent unauthorized access to your account and personal information by protecting your password and limiting access to your device or browser by signing off after you have finished accessing your account.

We take all reasonable technical, administrative and physical security measures designed to protect your information from any kind of loss, misuse, unauthorized access, alteration or destruction. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data. We try our best to protect your information, but we cannot guarantee complete security for any of your given information.

We collect information about your usage and activity on our Sites using certain technologies, such as: cookies, web beacons, and other technologies. Third parties may also view, edit, or set their own cookies. We and our third-party service providers, advertisers, and/or partners may also place web beacons for such third parties. You may, of course, at any time opt not to provide us with some or all of your information, but keep in mind that without certain information we may not be able to provide you with our services or certain features of our services. If you do not want to receive marketing and promotional emails from Dining Hour, you may click on the "unsubscribe" link in the email to unsubscribe and opt-out of marketing email communications. If you no longer want to receive push notifications from Dining Hour, you can use the settings on your mobile device to enable or turn off mobile push notifications from Dining Hour.

11. Links to Third Party Websites

Dining Hour may include links to other websites. Such sites are governed by their respective privacy policies, which are beyond our control. Once you leave our servers, use of any information you provide is governed by the privacy policy of the operator of the site you are visiting. That policy may differ from ours.
